Solid Waste - Ordinance No. 2005-05 and 2009-13 Requirements

The following acts are prohibited.

Depending on the violation, violators can be issued a warning, assessed additional permit trip punches on permits, and/or issued citations to appear in court, and if convicted can be fined, and or can face time in jail.

  • Permit Abuses
  • Uncovered Loads
  • Unbagged Loads
  • Not properly preparing or disposing of materials as specified
  • Disposal in Unauthorized Locations or After Hours at Transfer Stations
  • Delivery and disposal of Prohibited Materials
  • Delivery and disposal of Hazardous Wastes
  • Misuse of Recycling Bins/Areas
  • Scavenging
  • Interference with Caretakers or Other Santa Fe County Employee
  • Disposal rather than recycling of Required Recycling Items
  • Delivery of Large Loads
  • Illegal Dumping
  • Accumulation of C & D Debris
  • Open Burning
  • Accumulation of Solid Waste
  • Failure to follow written or posted policies

Details Regarding New Violations

Large Loads - Residential loads weighing more than 4,200 pounds net weight or having a volume greater than 21.33 cubic yards, must be deliverd to Buckman Road Recycling and Transfer Station (BuRRT). Load greater than 12,500 pounds must be deliverd directly to Caja Del Rio Landfil. Persons unwilling to take loads to the BuRRT or the Caja Del Rio Landfill can be issued a criminal citation, and if found guilty, issued a fine not less than $100.

Uncovered Loads - All loads delivered to any of the seven Transfer Station must be covered and/or secured. Any person delivering uncovered loads will be assessed two (2) additional trips (punches) and/or issued a citation. If found guilty the criminal penalty shall be a fine of not less than $50.

Unbagged Loads - All loads of garbage, refuse, rubbish, solid waste, pet wastes delivered to any Transfer Station must be bagged. Any person delivering unbagged loads will be assessed one (1) additional trip (punch) and/or issued a citation. If found guilty the criminal penalty shall be a fine of not less than $25.

Prohibited Materials - Delivery and disposal or attempted delivery of Prohibited Materials can result in confiscation of a permit, loss of a permit for 1 year. If a citation is issued, and person is found guilty can be issued a fine not less than $200 nor more than $300 and/or up to 30 days in jail.

Disposal of wastes at unauthorized locations within the Transfer Station or leaving wastes at a Station after hours - Upon conviction after issuance of a citation, the criminal penalty shall be not less than $100 nor more than $300 or up to 30 days in jail.

Permit Abuses - Obtaining a permit under false pretenses, using a permit for other than its authorized purposes, unauthorized transfer of a permit to another person or counterfeiting of permits. Misuse of permits will result in confiscation of permit and loss of privilege of involved persons to use County Transfer Stations for 1 year. If citation is issued, and person is found guilty, the criminal penalty shall not be less than $300 and/or up to 2 days in jail.

Not properly preparing or disposing of materials as specified - Written warning, or issuance of a citation. If found guilty, the criminal penalty shall be a fine of not less than $50.

Delivery and disposal of hazardous waste - Confiscation of permit, and permanent loss of privilege to use Transfer Stations. If citation issued, and person charged is found guilty, the criminal penalty shall be a fine of not less than $5,000 and or 90 days in jail.

Misuse of Recycling Bins and Areas - Written warning or issuance of citation. If person charged is found guilty, criminal penalty shall be a fine not less than $50.

Scavenging - (Within any transfer station other than at established "reuse agreas"). Written warning or issuance of citation . If found guilty the criminal penalty shall be a fine not less than $50.

Interference with Caretakers or other County Employees - Issuance of a citation, if found guilty the criminal penalty shall be a fine of not less than $100 nor more than $300.

Illegal Dumping - Issuance of citation, if found guilty criminal penalty not less than $300 nor more than $500 and/or 60 days in jail for the 1st offense.

Required Recycling - Most pulp-based materials are required to be recycled. Written warning or issuance of citation. If found guilty, the criminal penalty shall be a fine not less than $25.00. See details provided with recycling information.
